About the Position

The Department of Home Affairs is looking for experienced legal professionals to join our team. The role involves high-level legislative drafting, legal advisory, and ensuring the department operates within the South African legal framework.

Salary

A basic salary package of R586,956 to R1,386,972 per annum. The final salary will be determined based on the Occupation Specific Dispensation (OSD) for Legally Qualified Personnel.

Minimum Requirements

  • An LLB degree recognized by SAQA.
  • At least 8 years of relevant post-qualification legal experience.
  • A minimum of 3 years of experience in legislative drafting is highly preferred.
  • Admission as an Attorney or Advocate is an added advantage.
  • A valid driver’s license and willingness to travel or work extended hours when necessary.

Required Knowledge and Skills

Candidates should have a strong understanding of:

  • The Constitution of South Africa and the general legal system.
  • Legislation administered by the Department of Home Affairs.
  • The Public Service Act, Public Finance Management Act (PFMA), and Treasury Regulations.
  • Promotion of Access to Information Act (PAIA) and Protection of Personal Information Act (POPIA).
  • Strategic leadership, project management, and financial management.
  • Excellent legal drafting and communication skills.

Key Responsibilities

  • Legislative Drafting: Draft and amend primary and secondary legislation managed by the Department.
  • Parliamentary Support: Guide Bills through the legislative process in Parliament and engage with the Office of the Chief State Law Adviser.
  • Legal Opinions: Provide clear written and verbal legal advice regarding department legislation and PAIA requests.
  • Agreements: Review and draft international agreements and Memoranda of Understanding (MOUs).
  • Compliance: Ensure the department meets all audit requirements, risk management standards, and legal policies.
  • Management: Oversee resource utilization, manage staff performance, and assist in developing operational and strategic plans.
  • Digital Transformation: Support the department’s shift toward digital systems and modern technology.
